Terms of Service

1. Acceptance of Terms
By accessing or using Vervox AI (“the Service”), operated by The Trustee for Vithon Holdings Trust (ABN 96 894 762 787), trading as Vervox (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Vervox AI is an AI-powered phone receptionist service that answers incoming calls on your behalf, engages callers in natural conversation, collects information, and delivers lead details to you via SMS, email, and a web dashboard.
3. Account Registration
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to use the Service.
- One Twilio phone number is provisioned per account. Phone numbers must be unique across all accounts.
4. Free Trial
New accounts receive a 30-day free trial. A valid credit card is required to activate the trial, but you will not be charged during the 30-day trial period. We send a reminder email approximately three (3) days before the trial ends and your subscription will only convert to a paid plan if you confirm your subscription before the trial expires. If you do not confirm, we will not charge your card and your subscription will be paused; you may reactivate at any time. You may also cancel during the trial from your dashboard.
5. Subscription & Billing
- Paid plans are billed monthly via Stripe. Prices are in Australian Dollars (AUD) unless stated otherwise.
- Pay As You Go (PAYG) plans are charged a fixed monthly base fee plus a per-voice-minute rate for the time the AI is on the call (30-second minimum, then 6-second increments). Current rates are published on our pricing page.
- You can upgrade, downgrade, or cancel your subscription at any time from the Billing page.
- Refunds are handled on a case-by-case basis. Contact support for refund requests.
- We reserve the right to change pricing with 30 days’ notice via email.
6. Acceptable Use
You agree not to use the Service to:
- Engage in any illegal activity or facilitate illegal transactions
- Make or receive fraudulent, harassing, or threatening calls
- Violate any applicable telecommunications regulations
- Attempt to reverse-engineer, decompile, or interfere with the Service
- Resell or redistribute the Service without our written consent
- Use the Service in any way that could damage or impair our systems
7. Call Recording & Consent
Vervox records inbound calls answered by the AI on your behalf. Every call opens with a recording disclosure before any private content is exchanged — the disclosure is locked on at the policy layer and is chosen to satisfy the strictest two-party-consent states (VIC, WA, SA). You can customise the wording of the disclosure from the call-handling settings, but you cannot turn the disclosure itself off. The full call-recording consent notice describes the federal (TIA Act) and state-by-state context in detail. It remains your responsibility to ensure that any onward use of recorded content complies with applicable laws.
8. AI-Generated Content
The AI receptionist generates responses in real time. While we strive for accuracy, AI-generated conversations may occasionally contain errors or misinterpretations. Vervox is not liable for actions taken based on AI-generated information. You should verify critical details (such as emergency situations) independently.
9. Data Ownership
- You retain ownership of your business data, lead information, and call recordings.
- We may use anonymised, aggregated data to improve the Service.
- You can export or delete your data at any time via the dashboard or by contacting support.
10. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. The Service depends on third-party providers (Twilio, AWS, Deepgram) whose outages are beyond our control. We will notify you of planned maintenance in advance where possible.
11. Limitation of Liability
To the maximum extent permitted by law, Vervox AI and The Trustee for Vithon Holdings Trust shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
- You may cancel your account at any time from the dashboard or by emailing support.
- We may suspend or terminate your account for violation of these Terms, non-payment, or if required by law.
- Upon termination, your business data, leads, call recordings and transcripts are purged within 30 days, unless you request earlier deletion. During an active subscription, call recordings are retained for the life of the subscription plus 90 days. 13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria.
